§ 1 General, scope of application of the GTC

1.1 All deliveries and services are provided exclusively on the basis of the following General Terms and Conditions (hereinafter "GTC") in the version valid at the time of the order.

1.2 The contractual partner is WEIN-GENUSSREIF.DE, Alemannenstr. 4, 79346 Endingen, represented by Petra Wilhelm (hereinafter "Seller").

1.3 Customers within the meaning of these Terms and Conditions may be consumers (hereinafter "Customer"). Consumers within the meaning of the terms and conditions are natural persons who conclude contracts for a purpose which cannot be predominantly attributed to their commercial or professional activity.

§ 2 Conclusion of contract, realisation of the contract

2.1 The offers and article presentations do not constitute a binding offer. Only your order is a binding offer in accordance with § 145 of the German Civil Code (BGB), which we can accept. After sending your order, we will first send you an order confirmation by e-mail. If we accept your order, you will receive an order confirmation by e-mail within 5 working days of receipt of your order, with which the contract is concluded.

2.2 Once you have found the product you want, you can take a closer look at it without obligation by clicking on the product name or the product image. You can add the item to your shopping basket by clicking the [Add to basket] button. You can view the contents of the shopping basket at any time without obligation by clicking on the [Shopping basket] button. You can remove or change the products from the shopping basket by clicking on [Change] and [Delete]. If you wish to purchase the products in the shopping basket, click on the [Checkout] button on the "Shopping basket" page.

During the rest of the ordering process, you will set up a customer account with us for your first purchase and select the shipping and payment method. In the last step, you will receive an overview of your order data under "Order information" and can check all details again and delete or change them under [correct]. You can also correct input errors by navigating backwards in the browser or cancelling the order process and starting again. To finalise your purchase, you must accept our General Terms and Conditions and click on the [Buy] button. This will send the order to us.

§ 3 Storage of the contract text

We save your order, the order data entered and the entire text of the contract. We will send you an order receipt and order confirmation with all order data and the entire text of the contract by e-mail.

§ 4 Prices and shipping costs

All prices are inclusive of VAT. We deliver with [DHL, UPS etc.] or another provider of our choice.

§ 5 Terms of delivery

5.1 We deliver exclusively within Germany.

5.2 Unless otherwise stated in the offer, the goods will be delivered as quickly as possible.

§ 6 Terms of payment

Payment can be made in advance by bank transfer, credit card (VISA, MasterCard), immediate bank transfer, direct debit or on account.

We reserve the right to exclude individual payment methods.

If the payment method purchase on account is selected, the purchase price is due after the goods have been delivered and invoiced. In this case, the purchase price must be paid within 14 (fourteen) days of receipt of the invoice without deduction, unless otherwise agreed.

We reserve title to the purchased item until the invoice amount has been paid in full.

The purchase price shall bear interest at a rate of 8 percentage points above the base interest rate from the date of default of payment during the period of default.

§ 7 Warranty

If you are a consumer, the warranty is subject to the statutory provisions.

§ 8 Liability

We shall be liable without limitation for intent and gross negligence and in accordance with the provisions of the Product Liability Act. In cases of slight negligence, we are liable for injury to life, limb and health of persons.

In other cases, we shall only be liable for slight negligence in the event of a breach of material contractual obligations. Material contractual obligations are those whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner relies. Liability in the event of a breach of such an essential contractual obligation is limited to the damage typical of the contract, the occurrence of which we had to expect at the time of conclusion of the contract on the basis of the circumstances known at that time. This limitation of liability shall also apply in favour of our vicarious agents.

§ 10 Miscellaneous

The contract language is German.

We are not willing or obliged to participate in a dispute resolution procedure of the consumer arbitration boards.

If one or more provisions of these GTC are invalid, the remainder of the contract shall remain valid. Insofar as the provisions are invalid, the content of the contract shall be governed by the statutory provisions.
